Elouise Whitfield, a 39-year-old Black woman, is charged with giving cocaine to her newborn son after he tests positive for cocaine. Previously, her other two children had also tested positive for cocaine and were put into foster care.

The state drops the charges, citing State v. Gethers, 585 So.2d 1140 (Fla. 4th Dist. Ct. App. 1991), which affirmed that "a likelihood for conviction for cocaine transferred prior to birth did not currently exist" (Pregnancy Justice, 1992).
