The theory of “constructive possession” requires no affirmative act on the part of an individual in order for criminal liability to attach.

Under this act, the "possession of contraband" presumes that being near contraband can make you liable as an accomplice. Women in particular become vulnerable to being charged with possession of contraband placed in their home by a family member and/or partner.
